Criminal law --- Charter of Rights and Freedoms — Right to be tried within reasonable time [s. 11(b)] — Pre-trial delay It was alleged that on November 11, 2011 accused S, G and J were involved in kidnapping of victim and that they held her against her will and forced her to give them her pin numbers — Next day victim was reported missing and following day police found her after receiving tip — Accused were charged with kidnapping, extortion, and assault — There were problems with disclosure and as result mistrial was ordered — New trial was scheduled to start 34 months after information was laid, and to take three months — Accused alleged their right to trial within reasonable time under s. 11(b) of Canadian Charter of Rights and Freedoms was violated — Accused brought application for stay of proceedings — Application dismissed
